Privacy Statement for OMICRON Software Products
1 Scope and Field of Application
This is a Privacy Statement of OMICRON electronics GmbH and its worldwide offices. Should you need a different language version, kindly contact us at below contact details.
With this Privacy Statement (“Statement”) OMICRON informs you about the processing of your Personal Data while using OMICRON software tools and the rights you are entitled to under applicable data protection laws.
This Privacy Statement is applicable for the following software tools:
Non-cloud based
- Primary Test Manager (“PTM”) and the mobile Application PTMate (“PTMate”)
- CMC Swift Application (“CMC Swift”)
- ARCO Control Application (“ARCO Control”)
- CMControl P Application (“CMControl P”)
- CMControl R Application (“CMControl R”)
Cloud-based
- CPXpert Application (“CPXpert”)
- CPX Touch Control (“CPX TC”)
- PTM Data Sync Web (“PTM Web”)
these tools are hereinafter individually referred to as “Application” or together as “Applications”.

3 Processing of Personal Data through Applications
While our Applications mostly work without the processing of personal data, we sometimes use personal data as detailed below.
3.1 What kind of Personal Data does OMICRON process?
3.1.1. Non-cloud-based applications
Unless stated differently, Applications only process Personal Data if it is directly provided/uploaded by the user while using the Application. The user can see which kind of information they are about to share with us when using the input mask. This may include:
- Address information;
- Contact information (name, phone number);
- Attachments as uploaded by the user (images, etc; these should typically be of technical nature without any personal data);
- IP address;
- Device serial number.
As all Applications run on user-owned “on premise”, OMICRON has no control over or access to any Personal Data uploaded by the user unless the user intentionally shares the data with OMICRON, e.g. contact details for troubleshooting.
3.1.2. Cloud-based Applications
When using cloud-based Applications (see the distinction at section 1), We may process the following Personal Data additionally:
- User data (username, email, company);
- Authentication data;
- Activity records (created projects and reports, executed tests, conflict creator, IP address and last access).
3.2 For what purposes does OMICRON process your Personal Data?
3.2.1. Contractual purposes
We use your data to maintain your contact details, handle orders including billing, and fulfil our contractual obligations including license management, after-sales and warranty services, technical support services, as well as dispute resolution or receivables management.
Cloud-based Applications additionally use user data and authentication data to manage access to cloud-stored information.

3.2.2. Compliance with legal obligations;
We may store data despite deletion requests when we are required to do so for legally binding retention periods. We may also use contact information for product recalls under product safety law, or to handle any data protection rights requests rights request (see sec. 5 below).

3.2.3. Improvement of products and services
We may use your IP address, device serial number, contact details and attachments to evaluate usability and improvement potential of our product performance. This may include contacting you to improve general communication with our customers or exchange knowledge with you.
Cloud-based Applications may additionally use activity records for this purpose.
You may for the future withdraw your consent or object to use of your data in this way at any time.

3.3. Disclosure: To whom does OMICRON forward your Personal Data?
To ensure security and efficiency of the working environment, OMICRON may use third parties such as IT service providers, data centers, databases, consultants or other IT services. If OMICRON discloses Personal Data to third-party data processors, OMICRON ensures to have written agreements in place with all service providers which contain at least the minimum requirements as per applicable data protection laws.
Except as for cases already stated above, OMICRON only discloses Personal Data if the user has explicitly provided its consent, or the disclosure is necessary to exercise or defend legal claims, or OMICRON is legally obliged to do so or required for the processing of the contractual relationship with you. The latter is the case when you have ordered the “PTM DataSync WEB License”, where data (including Personal Data) generated through PTM is hosted through a Microsoft Azure cloud-based service (more privacy information regarding Microsoft Azure can be found at https://privacy.microsoft.com/en-us/PrivacyStatement).
3.4. Will data be transferred outside the EU?
Some of our affiliated companies or third-party service providers may be seated outside the European Union (EU). Data transfers outside the EU are only authorized in case appropriate or suitable safeguards comparable to European data protection laws are ensured. For many countries, the EU has publicised adequacy decisions as available here. In case of data transfers to other countries, we rely either on adequate contracts (EU standard contractual clauses) or on authority-approved binding corporate codes of conduct. 3.5. Retention Period: How long does OMICORN store Your Personal Data?
OMICRON does not store your Personal Data longer than reasonably necessary to fulfil the purposes indicated in this Statement or allowed by applicable law. In any case, OMICRON stores your Personal Data based on the statutory storage obligations and periods or for periods where potential claims have not become time-barred. OMICRON may store your Personal Data longer than the retention period if and as long as this is needed for the enforcement and defense of specific legal claims.
4 Your Rights
Data protection laws provide you with the following rights:
a) Receive information on the processing of Personal Data by us (Art. 13, 14 GDPR);
b) Receive information on which Personal Data is stored and receive copies from Personal Data (Art. 15 GDPR);
c) Request rectification and erasure if Personal Data is not correct or not processed lawfully Receive information on which Personal Data is stored and receive copies from Personal Data (Art. 16 GDPR);
d) Request restriction of processing Personal Data under certain circumstances (Art. 18 GDPR);
e) Request data portability under certain circumstances;
f) Object to processing of Personal Data for the future or request deletion under certain circumstances, e.g. when the processing is based on Art. 6(1)(f) GDPR (Art. 17, 21 GDPR).
g) Withdraw your consent in cases where data processing is based on Art. 6(1)(a) GDPR (Art. 7(3) GDPR). Withdrawal has no impact on processing activities before the withdrawal.

In addition, you have the right to file a complaint with the competent supervisory authority (Art. 22(1) GDPR; for Austria the responsible authority is the “Österreichische Datenschutzbehörde”).
5 Changes to this Privacy Statement
OMICRON keeps this notice under regular review and will place any updates in this space.

Data Statement for OMICRON Software Products
1 Processing of other, non-personal data
OMICRON may be holding other data as defined by Article 2 (1) of Regulation (EU) 2023/2854 on harmonised rules on fair access to and use of data (“Data Act”). Subject to the conditions of the Data Act and applicable contractual arrangements, you may be entitled to request access to data stored at OMICRON. These may include the following:
1.1 Bug Reports and Statistics
In its Applications as defined in the Privacy Statement above at section 1, OMICRON uses Microsoft Visual Studio App Center, a service offered by a Microsoft Corporation company (One Microsoft Way, Redmond, WA 98052-6399, USA) to collect technical information such as bug and crash reports in order to obtain information about malfunctions within the Application and to provide improvements and bug fixes. These reports only contain anonymous information about the crash constellation, including the time of the malfunction, the Application version used, loaded software libraries and information about the device (no device identification numbers).
1.2 Customer Experience Improvement Program (CEIP)
OMICRON further uses Microsoft Application Insight services. Through this service, OMICRON collects technical information about the usage of the Application including anonymized IP addresses, geo-locations (IP-based), language settings, anonymized usernames, and used filenames. All statistics generated through this tool are based on anonymous data, which do not allow OMICRON any identification of the respective user. These statistics help us to assess the usage and requirements of our Applications and to identify and fix Application bugs quicker.
This data processing is based on the legitimate interest of OMICRON to continuously improve the software solutions provided. However, if you do not want to participate in this program, you can simply opt-out by deactivating sending CEIP data in the Application settings.
1.3 Location Data
While using PTM on a user device, location information generated directly by the user’s operating system can be added by the user to mark grounding system measurement locations conducted through PTM.
A similar location tracking feature to support grounding system testing is provided to the user while using PTMate. Upon user’s manual activation of this location tracking feature, the GPS infrastructure of the user’s mobile device will share user’s GPS location data via Bluetooth LE in the background of the mobile application (even when the app is closed or not in use) with the connected PTM software. As both, PTM and PTMate run on user’s own system infrastructure, location data will not be shared with OMICRON or any other third party.
